The Maker System, LLC, dba FieldFlo (“FieldFlo,” “we,” or “us”), respects your privacy and has adopted this policy to protect it.

This policy describes the types of information we may collect from you or that you may provide when you visit our website at https://fieldflo.com/ (the “Website”), use the FieldFlo software as a service application and platform (the “Platform”), or otherwise use our products or services that link to this policy (collectively with the Website and the Platform, the “Services”). This policy also explains our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect through the Services or through any emails, texts or other electronic messages exchanged between you and FieldFlo. It does not apply to information collected by:

  • Us offline or through any other means, including on any other website or application operated by FieldFlo or any third party (including our affiliates and subsidiaries).
  • Any third party (including our affiliates and subsidiaries), whether through any application or content (including advertising) that may link to or be accessible from or through the Services, or otherwise. These other third parties may have their own privacy policies, which you should read before providing information on or through them.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with this policy, you may not use the Services. By accessing or using the Services, you agree to this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of the Services after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Since many users of the Services are provided access to the Services through their employer, this policy often provides examples that are relevant to those users. As a result, examples provided in this policy may or may not apply to you depending on which Services you are using and your reason for using such Services.

Children Under the Age of 18

Our Services are not intended for children under 18 years of age. No one under age 18 may provide any information to, on or through the Services. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information to, on or through the Services, or through any of its features, register on the Website or the Platform, use the Services, or provide any information about yourself to us. If you believe we might have any information from or about a child under 18, please contact us at privacy@fieldflo.com.

Information We Collect About You and How We Collect It

We collect several types of information from and about users of the Services, including information:

  • By which you may be personally identified, such as name, email address, phone number, address, emergency information, employer information (including job title, union code and employee ID), training and certification records, and any other identifier or information by which you may be contacted online or offline, or which gives us information about you (“personal information”).
  • That is about you but individually does not identify you.
  • About your internet connection, the equipment you use to access the Services, and usage details.

We collect this information:

  • Directly from you when you provide it to us through your use of the Services or otherwise.
  • Automatically as you use the Services through usage analytics, observability tools and other methods. Information collected automatically may include usage details, IP addresses, device details, referring URL, browser type and version, access times, pages viewed, session activity and location. It also includes information collected through cookies, web beacons, digital fingerprinting techniques and other similar technologies.
  • From third parties including our business partners and your employer. Without limiting the foregoing, if you are using the Services at the request of your employer or as part of your employment, your employer may provide us with the contact and employment information necessary for you to use the Services in connection with your employment, which can include hiring paperwork and medical documents like blood and drug tests.

Information You Provide to Us

The information we collect through the Services may include:

  • Information that you provide by filling in forms while using the Services. This includes information provided at the time of registering to use the Services, subscribing to our Services (whether directly or through your employer), posting material, recording information in the Services, or requesting further services. We may also ask you for information at other times including when you report a problem with the Services.
  • Records and copies of your correspondence (including email addresses), if you contact us.
  • Details of transactions you carry out through the Services.
  • Photographs, files and documents that you upload into the Services.
  • Your search queries within the Services.
  • Approximate location metadata from your mobile device. This allows us to record your position while you are working on projects for your employer.

You also may provide information to be published or displayed (hereinafter, “posted”) on public or private areas of the Website, the Platform or third-party apps, programs or sites, or transmitted to other users of the Services or third parties (collectively, “User Contributions”). Your User Contributions are posted and transmitted to others at your own risk. Although we limit access to certain portions of the Services, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of Services or third parties with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons or improperly used by others.

Information We Collect Through Automatic Data Collection Technologies

As you navigate through, use and interact with our Services, we may use automatic data collection technologies to collect certain information about your devices, and your browsing and usage actions and patterns, including:

  • Usage Details. When you access or use the Services, we may automatically collect certain details regarding such access or use, including traffic data, location data, logs, and other communication data, and the resources that you access and use on or through the Services.
  • Device Information. We may collect information about your mobile device or computer, and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information, and the device's telephone number.
  • Stored Information and Files. Depending on the Services you use and your device settings, the Services also may access metadata and other information associated with photographs, files and documents uploaded to or stored in the Services or on your device.
  • Location Information. The Services may collect real-time information about the location of your device.

If you do not want us to collect this information, do not download or use the Services and delete the Services from your device. You may also be able to opt out. Please note, however, that opting out of these technologies including the collection of location information, will disable certain features of the Services that rely on them.

We also may use automatic data technologies to collect information about your online activities over time and across websites, and we may use such technologies to link your activities and the activities of others across devices.  

The information we collect automatically may include personal information, or we may maintain it or associate it with personal information we collect in other ways or receive from third parties. This information helps us to improve the Services and to deliver a better and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns.
  • Store information about your preferences, allowing us to customize the Services for your needs and interests.
  • Recognize you when you use the Services.

The technologies we use for this automatic data collection may include:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer, or on your smartphone or other device. You may refuse to accept cookies by activating the appropriate setting on your device. However, if you select this setting you may be unable to access or use certain features included in the Services. Unless you have adjusted your settings so that your device will refuse cookies, our system may issue cookies when you use the Services.   • Web Beacons. Pages of the Website, the Platform and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit FieldFlo, for example, to count users who have visited those pages, used those Services or opened an email, and to gather other similar statistics (for example, recording the popularity of certain content and verifying system and server integrity).
  • Digital fingerprinting techniques and similar technologies. Digital fingerprinting is a tracking technique that creates an identifier for a user or a device based on the unique characteristics and settings of a user’s devices and online behavior. We may use, or allow third-parties to use, this type of technology for analytics and advertising purposes, as well as to ensure the functionality of the Services.

Third-Party Use of Cookies and Other Tracking Technologies

Some content or applications included in the Services, including advertisements, analytics and credit card processing, may be served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons, digital fingerprinting or other tracking technologies to collect information about you when you use our Services. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

  • To provide you with the Services. This includes uses related to the core functionality of the Services such as user authentication and account management; managing training, certifications, compliance documentation, timesheets, project management, and safety records.
  • To provide you with information, products, or services that you request from us.
  • To fulfill any other purpose for which you provide it.
  • To provide you with notices about your account and subscription, including expiration and renewal notices. We may also send you reminders, updates, and notifications (often via SMS text messages).
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • To notify you about changes or updates to our Services.
  • To allow you to participate in interactive features provided through the Services.
  • To improve features of the Services and improve user experience.
  • For security purposes.
  • In any other way we may describe when you provide the information.
  • For any other purpose with your consent.

We may also use your information to contact you about our own and third-parties’ goods and services that may be of interest to you. This may include sending emails, texts and newsletters. We may use the information we have collected from you to enable us to display advertisements to our advertisers’ target audiences. If you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose personal information that we collect or that you or a third-party (including your employer) provides as described in this privacy policy:

  • To our subsidiaries and affiliates.
  • To contractors, service providers, and other third parties we use to support our business including cloud service providers, SMS providers for notification delivery, and analytics providers.
  • To your employer if you are using the Services in connection with your employment.
  • To an investor, buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of FieldFlo’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by FieldFlo about the users of the Services is among the assets transferred.
  • Subject to the other restrictions in this policy, to third parties to market their products or services to you if you have not opted out of these disclosures. For more information, see Choices About How We Use and Disclose Your Information.
  • To fulfill the purpose for which you provide it.
  • To allow us to provide the Services to you.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce or apply our Terms and Conditions and other agreements between you and FieldFlo or between FieldFlo and third parties, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of FieldFlo, our customers, or others.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. You can also limit location sharing through device settings. If you disable or refuse cookies or location sharing, please note that some of the Services may then be inaccessible or not function properly. Please note that at this time FieldFlo does not respond to “Do Not Track” (DNT) signals.
  • Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your personal information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by sending us an email with your request to privacy@fieldflo.com.
  • Promotional Offers from FieldFlo. If you do not wish to have your contact information used by FieldFlo to promote our own or third parties’ products or services, you can opt-out by sending us an email stating your request to privacy@fieldflo.com. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to FieldFlo as a result of your registration for or use of our Services.
  • Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, you can opt-out by sending us an email stating your request to privacy@fieldflo.com.

We do not control third parties’ collection or use of your information to serve interest-based advertising. These third parties may allow you to choose not to have your information collected or used in this way. For example, you can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

Accessing and Correcting Your Information

You may send us an email at privacy@fieldflo.com to request access to, correct, or delete any personal information that you have provided to us. We may not be able to delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Employers and other business customers who manage access to and use of the Services for its employees or other uses may also manage access to individual employee records through the Platform.

Your State Privacy Rights

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. The exact scope of these rights may vary by state. To exercise any of these rights, or to appeal a decision regarding a consumer rights request, please sending us an email stating your request to privacy@fieldflo.com.

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. This includes encrypting data in transit and using access controls. We also use security monitoring tools and take other security measures.

The safety and security of your information also depends on you. Where you have been given (or where you have chosen) a password for access to the Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Services or through third-party tools and apps accessed through the Services. The information you share in such a manner may not be private.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through the Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained in the Services.

International Transfers of Data.

We may transfer the personal information we collect to countries outside of the jurisdiction where you are located to countries where we and our third-party service providers have business operations. If you are located in the European Union (the “EU”) or the United Kingdom (the “UK”), your personal information may be processed outside of the EU and UK including in the United States. We use appropriate safeguards when transferring and storing your personal information outside of your jurisdiction and we comply with all applicable data protection laws including the General Data Protection Regulation (“GDPR”) and the UK General Data Protection Regulation (“UK GDPR”). Changes to Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat our users’ personal information, we will notify you by email at the email address you have provided us through the Services. The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting and reviewing this privacy policy to check for any changes.

Your continued use of the Services after such changes will constitute your: (a) acknowledgment of the modified privacy policy; and (b) agreement to abide and be bound by the modified privacy policy.
